Guest Release and Waiver
Before participating in any activity offered in Gofreedly marketplace it is required that you accept the following Guest Release and Waiver, which is effective between you and your Host as of the date when you participate in an activity. All terms not defined here have the meaning given to them in the Gofreedly terms of service.
You acknowledge that you are 18 years of age or older. If you are bringing with you a minor as a Guest, you acknowledge and agree that you are solely responsible for the supervision of that minor throughout the duration of your activity, and have read this Guest Release and Waiver and agree to it on the minor’s behalf.
Assumption of Risks
YOU VOLUNTARILY ASSUMES ALL RISKS, BOTH KNOWN AND UNKNOWN, OF PARTICIPATING IN EACH ACTIVITY of personal injury, including temporary or permanent disability or death, property damage, economic losses, and/or other damages resulting from or in any way associated with your participation in activity booked via Gofreedly Platform.
You acknowledge and agree that this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT is intended to be, and is, a complete release of any responsibility of Releasees for personal injuries and/or temporary or permanent disability or death and/or property loss/damage sustained by you while participating in signed up activity.
Release and Waiver
You acknowledge and agree that:
- Within your reasonable understanding, you assessed the risks involved in the activity, and your choice to participate is well informed.
- You are solely responsible (not your host) for determining if you are fit and in good physical and mental health to participate in the activity.
- You must not take part in any activity or part of it if you are limited by physical, medical, or mental factors that hosts are not aware of.
- You will take all precautions and reasonable safety measures while participating in the activity and you will immediately stop if you notice a circumstance that is hazardous for your health.
You release and promise not to sue your host for any claims, demands or losses, damages or liability of any nature whatsoever connected with your participation in the activity whether based on warranty, contract, product liability, or any other legal theory.
Your intention is that this Guest Release and Waiver is a complete and unconditional release of all liability to the greatest extent allowed by law.
Disclaimer of Warranties
To the maximum extent permitted by law Host provides the activity on an "AS IS " basis without warranties of any kind whether expressed or implied.
Indemnification
You agree that if despite this Guest Release and Waiver, you or anyone on your behalf make a claim against the Host relating to an activity, you will indemnify and hold the Host of activity and GofreedlyP.C. harmless from any liability, demand, loss, damage, or costs which the Host may incur as the result of such claim.
You affirm that you have read this GUEST RELEASE AND WAIVER and fully understand the assumption of risk, release, waiver, and consent contained in it.
